User agreement

1. Definition

This User Agreement (hereinafter referred to as the “Agreement”) constitutes a public offer in accordance with Article 367 of the Civil Code of the Republic of Uzbekistan dated December 21, 1995 (https://lex.uz/ru/docs/111181#162763) and governs the procedure for the use of materials and Services of the website of the State institution “National PR Center” (hereinafter referred to as the “Enterprise”), available on the website and subdomains of the National Tourist Information Center: https://uzbekistan.travel/ (hereinafter referred to as the “Website”).

A Visitor and/or User confirms that they have read, fully and unconditionally accept all terms of this Agreement, and undertake to comply with them. Use of the Website by the User constitutes full acceptance of this Agreement “as is” by way of acceptance.

The Agreement enters into force from the moment of visiting any page of the Website and/or registration on the Website and remains valid indefinitely during the use of the Website’s Services. This Agreement is binding on all Visitors and Users without any exceptions or additional consents. The User undertakes to independently check the current version of the Agreement on the Website before using the Services.

2. Subject of the Agreement

The subject of this Agreement is the rules for the use of the Website’s materials and the provision to the Visitor and/or User of the opportunity to use the Website’s Services. The Enterprise holds the exclusive rights to the Website as a whole and to all its components, including all types of content: logos, trademarks, texts, articles, summaries, illustrations, photographs, graphics, audio and video files, user interfaces, design, structure, software, and databases.

3. Definitions

For the purposes of this Agreement, the following terms shall have the following meanings:

• Enterprise means the State institution “National PR Center”.
• Website means the Enterprise’s website: https://uzbekistan.travel/.
• Acceptance means the full and unconditional acceptance of the offer (the Agreement) by using the Website.
• Visitor means an Internet user who is not registered on the Website and who has access only to open resources.
• User means an Internet user who is registered in the Personal Account and uses the Website’s Services.
• Partner means an entrepreneur or legal entity that provides tourism services and products through the Website based on an agreement with the Enterprise.
• Product/Service means a tourism product or service provided by a Partner through the Website.
• Order means a tourism product/service reserved or paid for by the User through the Website.
• Website Service means the interface with the Personal Account for booking and paying for Orders.
• Registration means the voluntary completion by the User of contact information to obtain Services.
• Contact Information means the contact data provided by the User.
• Personal Account means the User’s self-service tool on the Website.

4. Rights of the Enterprise

The Enterprise shall have the right to:

• Refuse to provide the Services to the User in whole or in part without notice if the User violates the terms of the Agreement.
• Change the content of the Website, suspend Services, or completely cease operation of the Website for technical maintenance without prior notice.
• With individual notice via the Personal Account or email, amend the terms of the Agreement; such amendments shall take effect upon publication of the new version.
• Cancel any unpaid Order within ten (10) days.
• Process the User’s contact information provided during registration.
• Provide advisory information without warranties regarding third parties.
• Not be held liable for the non-compliance of any Product/Service with the User’s quality expectations.
• Not compensate for losses arising from failures or incorrect operation of the Service due to the actions of third parties.
• Block the Personal Account in the event of repeated violations of the terms of the Agreement.
• Record evidence of violations and store such evidence for no less than three (3) years.

5. Obligations of the Enterprise

The Enterprise shall:

• Ensure access to information, materials, and Services of the Website.
• Ensure access to the current version of the Agreement.
• Protect the User’s data in accordance with applicable law and the Privacy Policy.
• Take reasonable measures to prevent failures in the Website’s operation.
• Moderate comments and posts for compliance with applicable legislation.

6. Rights of the User

A User and/or Visitor shall have the right to:

• Use the Website’s Services within the scope of this Agreement.
• Use the Website’s data for lawful purposes without special permission.
• Leave objective comments.
• Contact the Enterprise regarding the Service at info@uzbekistan.travel.
• Refuse to use the Website and delete data from the Personal Account if they disagree with the Agreement.

7. Obligations of the User

The User shall:

• Familiarize themselves with and comply with the terms of the Agreement.
• Independently control access to their data and Personal Account.
• Not provide false information.
• Provide additional information upon the Enterprise’s request.
• Not engage in unlawful activities with payment instruments.
• Not interfere with the Website’s operation or violate the rights of third parties.
• Not damage the business reputation of the Enterprise.
• Comply with applicable legislation when publishing comments.

8. Prohibited Actions of the User

The User is prohibited from:

• Using automated scripts for mass copying of materials.
• Interfering with the Website’s operation or attempting to bypass technical security measures.
• Using the Service to distribute malware or spam.
• Publishing false or defamatory information about the Enterprise or other Users.

9. Liability of the User

The User shall bear full responsibility for any losses caused to the Enterprise or third parties. In the event of a violation of the terms of the Agreement, the Enterprise shall have the right to seek compensation for losses, court costs, and other expenses related to the restoration of rights.

The Enterprise shall have the right to record any violations (screenshots, audio, video recordings, notarized certification) and use such evidence in court. In the event of repeated violations, the Enterprise shall have the right to block the Personal Account without notice.

10. Miscellaneous

All matters not regulated by this Agreement shall be governed by the legislation of the Republic of Uzbekistan. All disputes shall be resolved in the courts of the Republic of Uzbekistan at the location of the Enterprise, regardless of the User’s citizenship. A Party affected by force majeure circumstances shall notify the other Party within three (3) days. All evidence of violations shall be recognized as legally valid. Claims and notices may be sent via the Personal Account and email.
